1.1 Who we are. We are Essential Flooring Ltd, trading as Essential Flooring, a company registered in England and Wales. Our company registration number is 06964697 and our registered office is at 114 Lothersdale, Stonydelph, Tamworth, Staffs, B77 4HX.

1.3 How we may contact you. If we need to contact you, we will do so by phone, email or post using the contact details you provided when placing your order.
OUR CONTRACT WITH YOU
2.1 Order acceptance. We accept orders only after we have checked them. After you place an order, we will contact you to confirm that we’ve received it and that we can fulfil it.
2.2 Order rejection. We may reject orders for reasons including, but not limited to: unexpected lack of stock; unsatisfactory credit checks; errors in pricing or description; or if you reside outside our delivery area. If we reject your order, we will try to suggest an alternative. If no acceptable alternative is available, we will refund any paid sums.
2.3 Order number. When we accept an order, we’ll assign it an order number and inform you. Please quote this number whenever you contact us about your order.
PRICE AND PAYMENT
3.1 Prices & extra fees. Product prices, payment terms, delivery, storage or other additional fees are those shown on our site/order pages when you place your order. We take reasonable care to ensure prices are correct at that time.
3.2 Payment timing. We charge you when we accept your order (or as otherwise stated). You own the products once they’ve been delivered.
3.3 Late payments. If payment is overdue, we may charge interest on the overdue amount at a rate of 4% per year above the Bank of England base rate, accruing daily until paid.
3.4 VAT and tax changes. If the rate of VAT (or any applicable tax) changes between the date you place your order and the date we deliver the products, we will adjust what you pay accordingly, unless you have already paid in full before the change takes effect.
3.5 Payment options. Where applicable, we may offer alternative payment options (e.g. instalments or deferred payment). Details will be shown during the checkout process.
PRICE MATCH PROMISE (if applicable)
4.1 We may match competitors’ prices under certain conditions. If you find an identical product at a lower price, under the terms we specify, we will either match that price before purchase or refund the difference if you inform us within a specified period after delivery.
4.2 Terms for price matching will generally include requirements such as: the competitor must be UK-based, product must be in stock, identical specification (grade, finish, size etc.), same delivery terms, etc.
ENVIRONMENTAL INITIATIVES (if applicable)
5.1 If we offer to plant a tree or similar environmental benefit with your order, this will apply to flooring purchases (or as otherwise specified). Accessories or sample orders may be excluded.
5.2 The planting or contributing to tree planting will be handled by a third-party partner, and details such as timing, location and eligibility will be clearly stated.
DELIVERY AND STORAGE
6.1 Delivery timings. We will deliver products in accordance with the method and timings you select at order. If products are out of stock, delivery dates are estimates.
6.2 Delays. We are not responsible for delays outside our control. If a delay is substantial, we will offer you the option to cancel and receive a refund for any undelivered products.
6.3 Failed delivery or absence. If you are not available at the time of delivery, or request changes after dispatch, additional charges (delivery or storage) may apply.
6.4 Storage. We may store your order upon your request or in case of failed delivery. Storage charges or free storage terms will be as per what is specified clearly.
6.5 Ownership & risk. Once delivered to your address (kerbside or as agreed), the products are your responsibility. Inspect products on arrival. If delivery requires a signature, signing means you accept condition and quantity unless damage or shortage is clearly noted.
OUR PRODUCTS
7.1 Nature of products. Colours, finishes and natural materials (particularly wood) may vary slightly from samples or images. Such variations are not defects.
7.2 Your responsibility for measurements. It’s your responsibility to ensure measurements and quantities (including wastage) are correct.
7.3 Wood grading. If we supply rustic or other graded wood flooring, you understand that certain levels of variation in knotting, colour, and grain are normal.
7.4 Free sample policy. Sample offerings (if free) are for you to test product suitability; excessive or commercial misuse of sample requests may lead us to limit or refuse future sample orders.
YOUR LEGAL RIGHTS
8.1 Cancellation / Returns. For most products you may cancel within 14 days of delivery, but we may offer an extended return period (e.g. 30 days) under our policy.
8.2 Exceptions. Certain products cannot be returned once opened or used (e.g. personalised or made-to-measure items; sealed hygiene products once unsealed; etc.).
8.3 Reporting damage. If goods arrive damaged or incorrect, you must inform our Customer Service within a certain time period (e.g. 14 days) from delivery.
8.4 Returns process. Follow our returns guidelines. Goods must be returned in original condition, in original packaging, with proof of purchase. Return costs are usually borne by you unless otherwise stated.
8.5 Refunds. Once we receive returned goods (or proof of their return) and verify condition, refunds will be made using the original payment method, usually within 14 days.
8.6 Storage-service cancellation and related fees (if applicable). If you have ordered storage or requested holding your order, cancellation and associated fees will be governed by specific terms.
8.7 If you fail to collect goods or orders after a given storage period (e.g. 90 days), we may cancel contract or apply storage fees.
CHANGES TO PRODUCTS AND TERMS
9.1 Minor changes. We may make minor technical changes to our products or terms (for example to comply with law) without notice when they do not materially affect what you receive.
9.2 Major changes. If we intend to make material changes to products or these terms, we will notify you in advance. You may have the right to cancel under such circumstances.
TERMINATION
10.1 We may terminate the contract if you breach your obligations (e.g. non-payment, non-cooperation, failure to accept delivery).
10.2 If we end the contract in such cases, we may claim compensation or deduct any costs incurred (e.g. for storage etc.).
LIMITATIONS OF LIABILITY
11.1 We (Essential Flooring) are liable only for losses which are foreseeable and which we could reasonably expect at the time of entering into the contract.
11.2 We will not be responsible for indirect, extraordinary or business losses (including loss of profit), except where required by law.
11.3 We are not liable for issues arising from improper installation, misuse, or failure to maintain the product as per guidelines.
OUR USE OF YOUR PERSONAL DATA
12.1 How we use personal data will be as per our Privacy Policy.
USE OF IMAGES AND MEDIA
13.1 If you tag @essentialflooring in social media, use our hashtags, upload media for product reviews or share photos with us, you may grant us permission to feature your images/media across our website, social channels, emails and marketing materials.
13.2 We will credit your social media handle where possible but need not include other personal details.
DISPUTES
14.1 Complaints. If you have problems with your order, product or service, please contact our Customer Service at [Insert phone] or [Insert email].
14.2 Alternative dispute resolution. You may have the option of using ADR (an independent body) before legal proceedings.
14.3 Governing law & jurisdiction. These terms are governed by the laws of England and Wales. If you reside elsewhere in the UK, you may bring claims in the courts of that jurisdiction.
OTHER IMPORTANT TERMS
15.1 We may transfer our rights under the contract to another company; we will inform you in writing if so, ensuring your rights are not reduced.
15.2 You may only assign or transfer your contractual rights with our agreement.
15.3 No third party may enforce this contract unless expressly authorised.
15.4 If any part of these terms is found to be invalid, the rest remain in force.
15.5 Delay in enforcing rights does not waive them.
